Terms and Conditions — Operator Portal

These Terms and Conditions (“Terms”) govern your use of the Operator Portal (“Portal”) provided by Winners Media Limited (“we”, “us”, “our”, “Winners Media”). By registering for an account on the Portal, you (“Operator”, “you”, “your”) agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not register for or use the Portal.

Important: These Terms form a legally binding agreement between you and Winners Media Limited. Please read them carefully before registering.

1. Definitions

In these Terms, the following definitions apply:

  • “Content” means any text, images, logos, offers, promotions, site descriptions, and other materials submitted by the Operator through the Portal.
  • “Listing” means the inclusion of an Operator’s gambling site or brand on one or more websites within the Network.
  • “Listing Fee” means the fee of £50 (excluding VAT where applicable) payable per Listing, unless waived in accordance with Section 5.
  • “Network” means the collection of gambling comparison and affiliate websites owned and operated by Winners Media.
  • “Portal” means the online self-service platform provided by Winners Media through which Operators manage their Listings, sites, and offers.
  • “Services” means the listing, distribution, and display services provided by Winners Media through the Portal and the Network.

2. About Us

Winners Media Limited is a company registered in England and Wales under company number 08173436. Our registered address is Wood & Disney Ltd, Lodge Lane, Langham, Colchester, England, CO4 5NE. We operate a network of gambling comparison and affiliate websites.

3. Eligibility and Registration

3.1 To register for the Portal, you must be an authorised representative of a gambling operator, affiliate programme, or related business entity.

3.2 You must provide accurate, current, and complete information during the registration process, including your company name, contact name, email address, and affiliate programme details.

3.3 You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorised access to or use of your account.

3.4 All registrations are subject to approval by Winners Media at our sole discretion. We reserve the right to refuse or revoke registration without providing a reason.

3.5 You must not create more than one account. If you wish to manage multiple affiliate programmes, please contact us.

4. The Services

4.1 The Portal allows Operators to:

  • Add and manage gambling sites and brands;
  • Add and manage promotional offers associated with those sites;
  • View where their sites are listed across the Network;
  • View approximate positioning data across Network websites;
  • Submit changes for review and approval.

4.2 All Content submitted through the Portal is subject to review and approval by Winners Media before being published on the Network. We reserve the right to reject, edit, or remove any Content at our sole discretion and without notice.

4.3 We do not guarantee any particular level of traffic, conversions, revenue, or positioning for any Listing. Positioning on Network websites is determined by Winners Media at our sole discretion and may change at any time.

4.4 We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice.

5. Listing Fees and Payment

5.1 Each Listing on the Network is subject to a Listing Fee of £50 (fifty pounds sterling), payable per site listed.

5.2 The Listing Fee may be waived at our discretion where the Operator provides a reciprocal testimonial or backlink on their own website in a form acceptable to Winners Media.

5.3 Listing Fees are non-refundable once a Listing has been published on the Network, except where required by law.

5.4 Payment must be made via the payment methods available on the Portal (currently Stripe). All payments are processed securely by third-party payment providers. Winners Media does not store credit or debit card details.

5.5 We reserve the right to suspend or remove Listings where payment has not been received or where a testimonial arrangement has not been fulfilled.

5.6 We reserve the right to change the Listing Fee at any time. Any fee changes will apply to new Listings only and will not affect existing paid Listings.

6. Operator Obligations

6.1 Licensing: You warrant that all gambling sites and brands submitted through the Portal hold valid gambling licences issued by the appropriate regulatory authority for each jurisdiction in which they operate. For sites targeting UK consumers, this means a valid licence issued by the UK Gambling Commission under the Gambling Act 2005.

6.2 Regulatory Compliance: You are solely responsible for ensuring that your gambling operations, promotions, and advertising comply with all applicable laws and regulations, including but not limited to:

  • The Gambling Act 2005 and associated secondary legislation;
  • UK Gambling Commission Licence Conditions and Codes of Practice (LCCP);
  • The UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (CAP Code);
  • The UK Code of Broadcast Advertising (BCAP Code);
  • Advertising Standards Authority (ASA) rulings and guidance;
  • Consumer protection legislation including the Consumer Rights Act 2015;
  • Anti-money laundering regulations;
  • Data protection legislation (see Section 9).

6.3 Accuracy: You warrant that all Content submitted through the Portal is accurate, truthful, not misleading, and up to date. This includes but is not limited to bonus amounts, wagering requirements, terms and conditions of offers, and geographic availability.

6.4 Responsible Gambling: You warrant that your gambling sites comply with responsible gambling requirements, including the provision of self-exclusion tools, deposit limits, and links to gambling support organisations such as GamCare and BeGambleAware.

6.5 Prompt Updates: You must promptly update your Content through the Portal if any information becomes inaccurate or outdated, particularly regarding promotional offers and their terms.

6.6 Prohibited Content: You must not submit Content that:

  • Is targeted at or likely to appeal to persons under 18 years of age;
  • Is misleading, deceptive, or likely to cause consumer harm;
  • Infringes the intellectual property rights of any third party;
  • Contains malicious code, links to harmful websites, or any form of malware;
  • Promotes unlicensed gambling operations;
  • Violates any applicable law or regulation.

7. Intellectual Property

7.1 You retain ownership of your Content, including your brand names, logos, and trademarks.

7.2 By submitting Content through the Portal, you grant Winners Media a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, distribute, and modify your Content for the purpose of providing the Services, including displaying your Listings across the Network.

7.3 This licence shall continue for the duration of your Listing on the Network and shall survive termination to the extent necessary to remove Content in an orderly manner.

7.4 You warrant that you have the right to grant the licence in Section 7.2 and that your Content does not infringe the intellectual property rights of any third party.

7.5 All intellectual property in the Portal and the Network (excluding Operator Content) belongs to Winners Media. You must not copy, reproduce, or reverse-engineer any part of the Portal or the Network.

8. Limitation of Liability

8.1 To the maximum extent permitted by law, Winners Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the Services.

8.2 Our total aggregate liability to you for any claims arising out of or in connection with these Terms shall not exceed the total Listing Fees paid by you to Winners Media in the twelve (12) months immediately preceding the claim.

8.3 Winners Media is not responsible for:

  • The regulatory compliance of any Operator or their gambling operations;
  • The accuracy of Content submitted by Operators (notwithstanding our review process);
  • Any losses arising from the suspension, modification, or removal of Listings;
  • Technical failures, downtime, or interruptions to the Portal or the Network;
  • The actions or omissions of third-party payment providers;
  • Changes in search engine rankings, traffic, or referrals.

8.4 Nothing in these Terms shall exclude or limit liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be lawfully excluded or limited.

9. Indemnification

9.1 You agree to indemnify and hold harmless Winners Media, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Terms;
  • Your Content or its use on the Network;
  • Your gambling operations or regulatory non-compliance;
  • Any claim by a third party relating to your Content or your use of the Services;
  • Your breach of any applicable law or regulation.

10. Data Protection and Privacy

10.1 Winners Media processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

10.2 When you register for the Portal, we collect and process the following personal data: your name, email address, company name, phone number (if provided), and website URL. This data is processed for the purpose of providing the Services and managing your account.

10.3 The legal basis for processing your data is the performance of a contract (these Terms) and our legitimate interests in operating the Services.

10.4 Your personal data may be shared with third-party service providers who assist us in operating the Portal (such as payment processors), but only to the extent necessary to provide the Services.

10.5 We will retain your personal data for as long as your account is active and for a reasonable period thereafter for legal and business purposes.

10.6 You have the right to access, rectify, erase, restrict processing, object to processing, and port your personal data. To exercise these rights, please contact us at info@winnersmedia.co.uk.

10.7 If you believe we have not handled your personal data properly, you have the right to lodge a complaint with the Information Commissioner’s Office (ICO) at ico.org.uk.

11. Termination

11.1 Either party may terminate these Terms by providing 30 days’ written notice to the other party.

11.2 Winners Media may suspend or terminate your account immediately and without notice if:

  • You breach any of these Terms;
  • Your gambling licence is revoked, suspended, or expires;
  • We reasonably believe your Content may cause legal liability or harm to Winners Media or its users;
  • You fail to pay any Listing Fees due;
  • You become insolvent or enter administration.

11.3 Upon termination, your access to the Portal will be revoked and your Listings will be removed from the Network within a reasonable timeframe.

11.4 Termination does not entitle you to a refund of any Listing Fees already paid.

11.5 Sections 7 (Intellectual Property), 8 (Limitation of Liability), 9 (Indemnification), 10 (Data Protection), and 14 (Governing Law) shall survive termination of these Terms.

12. Changes to These Terms

12.1 We reserve the right to amend these Terms at any time. Any changes will be posted on this page with an updated “Last updated” date.

12.2 For material changes, we will make reasonable efforts to notify you via email or through the Portal.

12.3 Your continued use of the Portal after any changes constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Portal and terminate your account.

13. General Provisions

13.1 Entire Agreement: These Terms constitute the entire agreement between you and Winners Media in relation to the Services and supersede all prior agreements and understandings.

13.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13.3 Waiver: No failure or delay by Winners Media in exercising any right under these Terms shall constitute a waiver of that right.

13.4 Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. Winners Media may assign its rights under these Terms at any time.

13.5 Third-Party Rights: These Terms do not confer any rights on any third party under the Contracts (Rights of Third Parties) Act 1999.

13.6 Force Majeure: Winners Media shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control.

14. Governing Law and Jurisdiction

14.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales.

14.2 Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
